12. What should I look for when choosing an executive law attorney?

Experience. Experience. Experience.
Experience as an employment attorney.
Experience representing employers on labor and employment law matters. (Nothing is more valuable than having worked the other side of the fence.)
Experience as an executive law attorney, making a significant professional commitment to the representation of senior executives.

Ask the lawyer who you are thinking of engaging how many executives he/she has represented. Describe your circumstances, briefly, and ask whether the attorney has dealt with your kind of situation previously. How many times?

Ask the lawyer for references and then check with those executives. Did those executives have situations like yours? How do they rate the attorney on responsiveness, knowledge of the issues, creativity and the ability to identify options and effectively counsel an executive through a strategic plan of action?

When choosing an executive law attorney, one factor that is relatively UN-important is the attorney's location. In most circumstances, the needs of an executive can be effectively evaluated and met over the telephone, by fax and e-mail. It is much more important to find a lawyer somewhere in your state who is experienced in executive law, than it is to locate a lawyer down the street who once knew an executive.
